(213) 229-5328 - The 1st District California Court of Appeal has allowed an equitable estoppel argument to prevent the assertion of the one-year statute of limitations for actions against a decedent under California code of Civil Procedure Section 366.2 Battuello v. Battuello, 98 Daily Journal D.A.R. 6035 (June 9, 1998). According to the allegations in a complaint filed by the decedent's son against his mother, the surviving spouse, the plaintiff's parents had promised him from an early age that the family vineyard would be his on the father's death. In reliance on the promise, the son studied viticulture and operated the farm from 1975 until the father's death in 1995.
